THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTIABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ORAL AGREEMENT, GUARANTEE, PROMISE, REPRESENTATION OR WARRANTY SHALL BE BINDING. IN NO EVENT WILL THE MANUFACTURER BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES EVEN IF THE MANUFACTURER HAS KNOWLEDGE THAT A DEFECT COULD CAUSE CONSEQUENTIAL ECONOMIC LOSSES. IN ANY EVENT, THE CUMULATIVE DAMGAGE FOR A BREACH OF THE WARRANTY WILL BE LIMITED TO THE AMOUNT OF THE PURCHASE PRICE OF THE PARTICULAR ITEM. THIS PARAGRAPH SHALL APPLY TO ALL ACTIONS RELATED TO THE GOODS, WHETHER BASED ON TORT, CONTRACT OR OTHER THEORIES. NO ACTION ARISING OUT OF THE BREACH OF WARRANTY MAY BE BROUGHT BY A PURCHASER MORE THAN ONE (1) YEAR AFTER THE DATE OF PURCHASE. UNDER NO CICUMSTANCES WILL THE WARRANTY BE EXTENDED BEYOND THE PERIOD SET FORTH HEREIN.

 

Manufacturer warrants that the goods shall be free from any defects in materials and workmanship for a period of ninety (90) days from the date of delivery. The manufacturer's sole and exclusive obligation under this Warranty shall be to remedy or replace any goods deemed to have a material or workmanship defect at no cost to the purchaser for materials and labor provided:

 

(1) The defect has been properly reported by the purchaser to the manufacturer; 
(2) The reported defect is reasonably determined upon investigation by the manufacturer to have arisen from a defect in materials or workmanship. 
(3) the purchaser agrees to pay shipping and handling charges. The purchaser is required to submit proof of purchase and to otherwise comply with the manufacturer's warranty claims procedures.

 

Procedures

 

(A) The purchaser or his/her agent, must notify the manufacturer of the defect within ninety (90) days of the purchase.
(B) The purchaser must upon demand, ship (prepaid) the defective item to the manufacturer for inspection within thirty (30) days of the notification of the defect.
